Work Comp Defenses for Matters of Equal Exposure in Normal, Non-Employment Life
Defining the risk source in a workers' compensation case is vital to determine if the incident will be compensable. In this presentation, the workers’ compensation defense of equal exposure in normal, non-employment life will be explored, showing how even though the accident may have occurred at work – the injured worker may not be entitled to workers’ compensation benefits if they are equally exposed to the same risk in their non-employment life. The MO Supreme Court has issued several decisions on this topic in the last few years, including Boothe vs. Dish Network, Johme v. St. John’s Heathcare, and Miller v. MODot.
